The Uttarakhand government has taken a big and historic decision. The State Cabinet has approved the Uttarakhand Minority Educational Institute Bill, 2025. After the implementation of this new bill, the Madrasa Board in the state will be over and the ongoing rules will also be canceled.
What is a new proposal?
The aim of the new law is only to extend madrasa education limited to the Muslim community to other minority communities such as Sikh, Jain, Christian, Buddhist and Parsi. That is, now not only Muslims but all recognized minority communities in the state will be allowed to run educational institutions.
The government believes that this will increase the scope of education and give equal opportunities to minority communities. However, concern is being raised about this proposal among the Muslim community. He says that it can violate their rights under Articles 26 and 30 of the Constitution. These articles give the right to run religious institutions and establish education institutions.
When will it apply?
If this bill passes in the assembly, then a new law will be implemented from 1 July 2026. Along with this, Uttarakhand Madrasa Board of Education Act, 2016 and Uttarakhand Non-Governmental Arabic and Persian Madrasa Recognition Rules, 2019 will also end. Interestingly, after the new law, education of languages like Gurmukhi and Pali will also be allowed in madrasas.
How does the madrasa board work now?
At present, the Madrasa Board has the right to prepare the syllabus, conduct examinations and inspect madrasas. The board’s recognition committee consists of a total of 13 members, including deputy registrars, members of a headmaster rank and other educational members. This committee decides which madrasa will get recognition and which is not. At present, 452 recognized madrasas are running across the state.
What will happen after the new law?
After the implementation of the new bill, strict rules will be made regarding the recognition of madrasas. Any minority educational institution will be recognized only when it is registered under the Society Act, Trust Act or Company Act. The land, bank accounts and assets of the institute will also be required in the name of the institute. If an institution has financial disturbances, lack of transparency or religious-social harmony activities, then its recognition can be withdrawn.
Impact on students
Currently, thousands of students associated with madrasas are getting both religious and general education. After the new law is implemented, the scope of studies for these students can increase because they will no longer have to be limited to Arabic-Persian, but they will also be able to learn other languages.
