Chief Justice of India (CJI) BR Gawai spoke with impunity against the bulldozer policy of the governments. CJI attended a program organized by Goa High Court Bar Association on Saturday (August 23, 2025) in Goa’s capital Panaji.
During this, while addressing the function, he said that he is happy that the Supreme Court’s decision against the demolition of the houses of the accused persons without following the legal process has upheld the rights of the citizens.
‘Executive cannot become a judge’
BR Gawai was part of the bench of the Supreme Court, which immediately criticized the ‘bulldozer justice’ and set guidelines for the demolition of the assets for the country. It was said in the judgment that the executive cannot become a judge and cannot declare any accused guilty nor can his house be dropped.
‘My decision was criticized by the people of my own community’
Addressing the function, the Chief Justice of the country also explained the argument behind his historical decision on ‘Creamy layer’ in the reserved category. Gawai said, “My decision was criticized by the people of my own community, but I always believe that I should write my decision not according to the wishes or pressure of the people, but on the basis of the understanding of the law and the voice of my conscience.”
Pointing to the speeches made by the former speakers during the honor ceremony, pointing to their historical decisions, CJI Gavai said, “I really are happy that as the patron of the Constitution we could do something to protect the rights of the citizens whose houses were demolished without following legal processes.”
